Validity of the GTC

(1) These General Terms and Conditions apply to contracts for the rental of holiday apartments for accommodation as well as all other services and deliveries provided by Ferienhaus Ivanka to the guest. The services of Ferienhaus Ivanka are provided exclusively on the basis of these General Terms and Conditions.

(2) The subletting or further rental of the rented holiday apartment as well as its use for purposes other than residential purposes require our prior written consent.

(3) The guest's terms and conditions of business shall only apply if they have been agreed in advance. Deviations from these conditions are only effective if we have expressly confirmed them in writing.


§ 1 Definitions

a) The terms "Studio Lucie", "Apartment Sarah", "Apartment Elsa", "we", "us" or "our" refer to Ferienhaus Ivanka, which is privately rented out.

b) The term "Ferienhaus Ivanka" refers to our website www.ferienhaus-ivanka.de

c) The term "Services" refers to all services provided by Ferienhaus Ivanka from time to time, including but not limited to the receipt of booking information through our booking and payment system, the management of reservations and payments, and the answering of customer inquiries through our reservation system and the management of content on third-party channels through our channel manager.

d) The term "Customer" refers to either: a) the person who makes a reservation or inquiry in their own name; or b) the organization at which the person makes a reservation or inquiry on behalf of an organization.

e) The term "Property" refers to any form of accommodation, building, houseboat, apartment, room, residential blocks, houses or other dwellings or rental spaces displayed by the customer or a third-party channel and offered for rental through the Services.

f) The term "Content" means text, graphics, images, music, software, audio, video, information or any other form of data.

g) The term "Customer Content" refers to content provided by the customer as part of the use of the Services, including but not limited to other information.


§ 2 Booking/Booking Confirmation

All booking requests must be made through our website www.ferienhaus-ivanka.de, by email info@ferienhaus-ivanka.de, or by phone at +49 173 538 5045. All requests made through any other method such as Facebook or Instagram will not be considered or answered with a delay.


If we can offer you the holiday apartment in your desired period, we will send you a written confirmation and the invoice by email. Your booking becomes legally valid upon receipt of the booking confirmation and after the deposit has been paid (see § 3 Payment Terms).


§ 3 Payment terms

Your booking becomes valid upon receipt of the deposit. The deposit of 30% of the rental contract is due for payment within seven days of receipt of the invoice. After the deposit has been received, the payment of the remaining balance is due four weeks before the start of the rental period. If the payment deadlines are not met, Ferienhaus Ivanka can withdraw from the contract. Non-payment is considered as cancellation and entitles Ferienhaus Ivanka to re-let the property.


Additional costs for water, parking, waste, or energy costs will not be covered.


§ 4 Arrival and departure

The holiday apartment is available from 3:00 pm on the day of arrival. The guest will receive information about the key handover 7 days before arrival by email. The guest should inform Ferienhaus Ivanka of the approximate arrival time in advance so that the key can be handed over on site. Claims for damages cannot be made if the holiday apartment cannot be occupied punctually at 3:00 pm.


On the day of departure, the apartment must be vacated by 10:00 am. If the guest wishes to check out later, this should be arranged with us in advance. A late check-out without prior arrangement will be charged.


If the guest does not appear on the day of arrival without prior notice until 10:00 pm, the contract is deemed terminated after a period of 48 hours without notification to Ferienhaus Ivanka. Ferienhaus Ivanka can then dispose of the property freely. A (partial) refund of the rent due to early departure is generally not possible.


The apartment must be left swept clean on the day of departure. The dishes, glasses, etc. must be cleaned and put away, the trash cans emptied, and the refrigerator cleared out. If the apartment is not left as desired, you may be charged for this.


§ 5 Vacation Apartments


We will hand over the vacation apartment to you in a clean and orderly condition with complete inventory. If you notice any deficiencies during your stay, you are obliged to inform the host immediately. The guest is liable for any damage caused by him/her to the rental property, the inventory (e.g., broken dishes, damage to the floor or furniture), including the cost of lost keys.


The inventory must be treated with care and diligence and is intended only for use within the vacation apartments. Moving furniture, especially beds, is not permitted. The guest is also liable for the fault of his/her fellow travelers. Damages caused by force majeure are excluded. In the event of non-contractual use of the vacation apartment, such as subletting, over-occupancy, disturbance of peace, etc., the contract can be terminated without notice, and the guest must leave the vacation apartment. The rental fee already paid remains with Ferienhaus Ivanka.


§ 6 Pets


The accommodation of pets of any kind in the vacation apartment is generally prohibited and, in exceptional cases, only allowed with the prior written consent of the provider. If animals are accommodated without the prior consent of the provider, a cleaning fee of up to 150 euros can be charged.


§ 7 Stay


The vacation apartment may only be used by the persons listed in the booking. If the apartment is used by more persons than agreed, a separate fee of 20 euros/person/night must be paid. Ferienhaus Ivanka also has the right to terminate the contract without notice in this case.


Subletting and handing over the apartment to third parties are not allowed. The guest agrees to the General Terms and Conditions as well as the house rules of the vacation apartments. The declaration of consent is made with payment.


In the event of violations of the terms and conditions or house rules, Ferienhaus Ivanka is entitled to terminate the rental agreement immediately and without notice. There is no legal entitlement to a refund of the rental fee or compensation.



§ 8 Cancellation of the trip


In the event of cancellation, the guest is obliged to pay a portion of the agreed price as compensation. Cancellations must be made in writing by email. The amount of compensation depends on the time until the day of arrival and is as follows:


up to 56 days before the day of arrival 30% of the agreed price


up to 28 days before the day of arrival 50% of the agreed price


up to 21 days before the day of arrival 70% of the agreed price


up to 14 days before the day of arrival 90% of the agreed price


§ 9 Cancellation by the landlord


In the event of cancellation by us due to force majeure or other unforeseeable circumstances (such as accident or illness of the host), as well as other circumstances beyond our control that make fulfillment impossible, liability is limited to the refund of costs. In the event of justified cancellation, the customer has no claim for damages - liability for travel and hotel costs is not assumed.


Cancellation by Ferienhaus Ivanka can be made without notice period after the rental period has begun.


§ 10 Liability of the landlord


Ferienhaus Ivanka is liable within the scope of due care for the proper provision of the rental property. Liability for any failures or disruptions in water or power supply, as well as events and consequences due to force majeure, are hereby excluded.


§ 11 Permission to use internet access via WLAN


Ferienhaus Ivanka maintains internet access via WLAN in its holiday apartments. It allows the guest to use the WLAN access to the internet for the duration of their stay in the holiday property. The tenant has no right to allow third parties to use the WLAN.


Ferienhaus Ivanka does not guarantee the actual availability, suitability, or reliability of the internet access for any purpose. It is always entitled to allow further users to use the WLAN for operation, in whole or in part, temporarily, and to restrict or exclude the tenant's access, in whole or in part, temporarily, if the connection is being or has been used for abusive purposes, to the extent that Ferienhaus Ivanka must fear being held liable and cannot prevent this with reasonable and customary effort within a reasonable time. Ferienhaus Ivanka reserves the right, in particular, to block access to certain pages or services via the WLAN at any time at its sole discretion (e.g. glorification of violence, pornographic or paid sites).


§ 11.1 Access data


The WLAN is accessed using access security. The access data (login and password) must not be passed on to third parties (i.e. persons not registered in the holiday apartments) under any circumstances. If the guest wishes to grant access to the internet via the WLAN to third parties, this is mandatory only with our prior written consent and the documented acceptance of the regulations of this usage agreement by the third party through signature and complete identity information. The guest is obliged to keep his access data secret. Ferienhaus Ivanka has the right to change access codes at any time.


§ 11.2 Dangers of WLAN use, liability limitation


The guest is informed that the WLAN only enables access to the internet and virus protection and firewall are not available. The data traffic produced using the WLAN is unencrypted. Therefore, the data can possibly be viewed by third parties. Ferienhaus Ivanka expressly points out that there is a risk that malicious software (e.g. viruses, Trojan horses, worms, etc.) can enter the end device when using the WLAN. The use of the WLAN is at the guest's own risk. We shall not be liable for any damage to digital media of the tenant resulting from the use of the internet access, unless the damage was caused intentionally or through gross negligence by us and/or our agents.


§ 12 House rules, general rights and obligations


(1) The guest is obliged to comply with the house rules, which are available for inspection in each apartment.
